This revision will set the tone for how evidence, consultation and competitiveness are balanced in one of the EU\u2019s most politically-sensitive policy areas.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-29eabfc e-con-full e-flex e-con e-child\" data-id=\"29eabfc\" data-element_type=\"container\" data-e-type=\"container\">\n\t\t\t\t<div class=\"elementor-element elementor-element-174422e elementor-widget__width-initial elementor-widget elementor-widget-text-editor\" data-id=\"174422e\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><strong><span style=\"font-size: 18px;\">Evidence first \u2013 or policy first? <\/span><\/strong><\/p><p><img decoding=\"async\" class=\"wp-image-5745 alignleft\" src=\"https:\/\/test-jtieuaffairs.be\/wp-content\/uploads\/2026\/04\/icons_9-3_1.png\" alt=\"\" width=\"67\" height=\"84\" \/>In its response to the consultation, Tobacco Europe highlighted a number of recurring shortcomings, including incomplete or delayed impact assessments, limited transparency in competitiveness analysis, and a consultation processes that risks becoming procedural exercise rather than genuine evidence gathering.<br \/><br \/>Better Regulation should mean evidence first, proposal second. Without timely and robust impact assessments, legislative initiatives create uncertainty, complicate compliance planning and weaken investor confidence \u2013 the opposite of what a competitiveness agenda should seek to achieve. <br \/><br \/>As the Commission prepares for the next TPD revision, these principles become even more essential.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-751a09c e-con-full e-flex e-con e-child\" data-id=\"751a09c\" data-element_type=\"container\" data-e-type=\"container\">\n\t\t\t\t<div class=\"elementor-element elementor-element-5fc0b48 elementor-widget__width-initial elementor-widget elementor-widget-text-editor\" data-id=\"5fc0b48\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><strong><span style=\"font-size: 18px;\">Consultation cannot mean exclusion <\/span><\/strong><\/p><p><img decoding=\"async\" class=\"wp-image-5745 alignleft\" src=\"https:\/\/test-jtieuaffairs.be\/wp-content\/uploads\/2026\/04\/icons_9-3_2.png\" alt=\"\" width=\"67\" height=\"84\" \/>The Commission has pledged to make consultations \u201csmarter.\u201d At its core, that must mean engaging with stakeholders who will be directly affected by legislation, or who can contribute relevant evidence and technical expertise. Inclusive, transparent consultation is not a concession to any one interest \u2013 it is a prerequisite for evidence-based policymaking and laws that work in practice.<\/p><p>In the tobacco space, however, wrongful interpretations of Article 5.3 of the WHO FCTC have too often resulted in the complete exclusion of legitimate economic operators from technical discussions that directly affect them. Safeguards against undue influence are essential \u2013 but blanket exclusion undermines regulatory quality.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-9763288 e-con-full e-flex e-con e-child\" data-id=\"9763288\" data-element_type=\"container\" data-e-type=\"container\" data-settings=\"{&quot;background_background&quot;:&quot;classic&quot;}\">\n\t\t\t\t<div class=\"elementor-element elementor-element-d55e40c elementor-widget elementor-widget-text-editor\" data-id=\"d55e40c\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>The exact wording of Article 5.3 of the WHO Framework Convention on Tobacco Control (FCTC) is:<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-bb4c2ae elementor-widget elementor-widget-text-editor\" data-id=\"bb4c2ae\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><strong>5.3. Protection of public health policies with respect to tobacco control from commercial and other vested interests<br \/>of the <\/strong><strong>tobacco industry.<br \/><br \/><\/strong>In setting and implementing their public health policies with respect to tobacco control, Parties shall act to protect these<br \/>policies from commercial and other vested interests of the tobacco industry in accordance with national law.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-1a501c7 elementor-widget elementor-widget-text-editor\" data-id=\"1a501c7\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Properly understood, Article 5.3 does not bar consultation with tobacco companies under Better Regulation principles but rather calls for safeguards to ensure that public health policy is not driven by vested interests.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-bb2f0c4 e-con-full e-flex e-con e-child\" data-id=\"bb2f0c4\" data-element_type=\"container\" data-e-type=\"container\">\n\t\t\t\t<div class=\"elementor-element elementor-element-07ab4d5 elementor-widget__width-initial elementor-widget elementor-widget-text-editor\" data-id=\"07ab4d5\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><strong><span style=\"font-size: 18px;\">Transparency is non negotiable<\/span><\/strong><\/p><p><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-5745 alignleft\" src=\"https:\/\/test-jtieuaffairs.be\/wp-content\/uploads\/2026\/04\/icons_9-3_3.png\" alt=\"\" width=\"67\" height=\"84\" \/>A recent decision by the European Ombudsman concerning the evaluation of the EU tobacco control framework (see <a style=\"color: #00bb31; font-weight: bold; text-decoration: none;\" href=\"https:\/\/test-jtieuaffairs.be\/index.php\/2024\/10\/08\/no-taxation-without-representation\/\" target=\"_blank\" rel=\"noopener\">Buzz@Bruss! #4 \u2192<\/a>) underscored the importance of clear and well communicated conflict of interest assessments. Even where legal thresholds are met, procedural opacity damages trust.<\/p><p>Process integrity matters as much as policy substance, especially in politically sensitive areas such as the TPD.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-7076bad e-con-full e-flex e-con e-child\" data-id=\"7076bad\" data-element_type=\"container\" data-e-type=\"container\">\n\t\t\t\t<div class=\"elementor-element elementor-element-f2a0601 elementor-widget__width-initial elementor-widget elementor-widget-text-editor\" data-id=\"f2a0601\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><strong><span style=\"font-size: 18px;\">Competitiveness beyond simplification<\/span><\/strong><\/p><p><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-5745 alignleft\" style=\"margin-left: 0px; margin-bottom: 15px; border-radius: 0px;\" src=\"https:\/\/test-jtieuaffairs.be\/wp-content\/uploads\/2026\/04\/icons_9-3_4.png\" alt=\"\" width=\"67\" height=\"84\" \/>The Commission increasingly frames competitiveness through simplification. Reducing administrative burden matters \u2014 but competitiveness cannot be reduced to uniform rules or ever more prescriptive standards applied across the board.<\/p><p>There is a risk that harmonization becomes an end in itself, leading to \u201cequalizing upwards\u201d in ways that constrain innovation, narrow market dynamics and discourage investment. In highly regulated sectors, like tobacco and nicotine, this can undermine the Single Market rather than strengthen it.<\/p><p>A Better Regulation agenda that genuinely supports competitiveness must therefore consider how rules affect innovation, investment and market openness. Regulation that closes markets or limits technological pathways does not enhance Europe\u2019s competitiveness \u2013 on the contrary.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-8a2f6c4 e-con-full e-flex e-con e-child\" data-id=\"8a2f6c4\" data-element_type=\"container\" data-e-type=\"container\">\n\t\t\t\t<div class=\"elementor-element elementor-element-061cbda elementor-widget__width-initial elementor-widget elementor-widget-text-editor\" data-id=\"061cbda\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><strong><span style=\"font-size: 18px; color: #00bb31;\">A real test, not a rhetorical one<\/span><\/strong><\/p><p>The Better Regulation consultation offers the Commission an opportunity to demonstrate that its commitments translate into practice \u2013 even in politically sensitive files. The upcoming TPD revision will be a decisive moment.<\/p><p>If Better Regulation is applied selectively, it risks becoming an empty label. If it is applied consistently \u2013 through robust evidence, inclusive consultation and transparent processes \u2013 it can strengthen both the quality and legitimacy of EU policymaking.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-43fd1f8 e-flex e-con-boxed e-con e-child\" data-id=\"43fd1f8\"
